Members considered a report of the Town Clerk regarding outstanding references from previous meetings and the following points were made.

 

·         In response to a request from the Chairman, the Town Clerk agreed to maintain the practice of providing numbered references within minutes going forward.

 

1 – Recruitment

 

·         In response to a comment from the Chairman, the Commissioner agreed to label this reference as ongoing pending the minutes of the 23 November Performance and Resource Management Sub-Committee meeting being circulated to Members.

 

2 – City of London Police Response to Government cycling consultation

 

·         The Chairman noted that this reference had been completed and could be closed.

 

3 – Report on income from fees and charges

 

·         The Chairman noted that, whilst this reference remained outstanding, the requirement for a report on income from fees and charges and the application of fees and charges could be merged into the wider work on the Medium-Term Financial Plan (MTFP) would be reported back to Committee in due course. The report should consider what items the Force was applying fees and charges to, and whether those fees and charges were set at the right rate.

 

4 – Update on Community Engagement Review and IAG Consultation

 

·         A Member noted that this reference had been a longstanding item on the outstanding references list and requested that he receive the briefing regarding the IAG outside of the meeting on what progress had been made prior to the Christmas period.

 

5 – Community Engagement Review Report

 

·         The Chairman noted that this reference would remain outstanding until the report had been submitted to Committee in January 2019.

 

6 – Report on Homeless Encampments

 

·         The Chairman noted that this reference was now complete and could be closed.

 

7 – Update on Training Roll-Out

Minutes:

Members considered a report of the Commissioner regarding Revenue and Budget Monitoring to September 2018 and the following points were made.

 

·         The Chairman highlighted the significant increase in the in-year and medium-term financial deficits, which would require further work on mitigations before a Medium-Term Financial Plan could be agreed.

 

·         The Commissioner of Police noted that he would go into greater detail on some elements of the report once the Committee was in non-public session. Part of his non-public update would be regarding proposed mitigation actions to achieve savings against the identified outturn overspend.

 

·         A Member noted that the projected outturn overspend should never have arisen and requested that the Commissioner provide Members with reassurance that the issue would not recur.

 

·         A Member noted that the table within the report was not in the format that had been requested by the Committee at previous meetings, and this meant it was difficult to gauge how historicthe identified financial issue was.

 

·         A Member requested reassurance from the Commissioner that appropriate financial controls were now in place; more clarity on the reasons for the £6.28m outturn shortfall in the Business Support Directorate; and noted that, in his view, the content of the report following paragraph 10 was not detailed enough to give Members the information they needed to appropriately scrutinise the Revenue and Budgets.

 

·         The Chairman concurred with these points and added that more clarity on reasons underpinning budget variances would be welcome.

 

·         The Commissioner reassured Members that the issues presented to Members were the ‘tail’ of a problem that was being proactively addressed. The Commissioner had reviewed in detail the reasons for the identified issues having first arisen. In short, the total unit cost of police staffing had proved to be higher than predicted which had masked an underlying error in income

Members considered a report of the Commissioner regarding the use of Spit & Bite Guards and Leg Restraints by the City of London Police and the following points were made.

 

·         In response to questions from Members, the Commissioner replied that use of the guards and restraints would be subject to a monitoring regime, and that they were in line with guards and restraints used by the three other London Police Forces.

Questions on matters relating to the work of the Committee

Minutes:

Stolen Mopeds – Police Tactics

In response to a question from a Member regarding whether the City of London Police was copying recent Metropolitan Police tactics of ramming stolen mopeds, the Commissioner replied that the City of London Police had undertaken joint work with the City of London Police and had therefore adopted the tactic described. The tactics were a response to a change in criminal tactics away from foot muggins to moped/motorcycle muggings.

 

In response to a further question, the Commissioner noted that Officers would be open to prosecution for using ramming tactics as, ultimately, as Police officers they remained accountable for their actions. That said, Police drivers were highly trained. The Commissioner agreed to ensure that due regard for the possibility of causing injury would be taken into account when applying the ramming tactic.

 

Police Committee - Term Limits

In response to a question from a Member, the Town Clerk agreed to include a review of whether a term limit for Common Council Members of the Police Committee should be introduced. The review would be mindful of the required terms of office for Chairman and Deputy Chairman.

 

Black Cab Blockades

In response to a question from a Member, the Commissioner replied that the current Black cab blockades within the City were authorised demonstrations and so were not subject to enforcement. However, the City of London Police would continue to monitor the situation and apply the tests set out within the Public Order Act (1986) to ensure the protests and Police response remained appropriate.
