A Sub-Panel consisting of three members drawn
from the Panel of Independent Persons.
The Hearing Sub-Panel is tasked with receiving
Complaints under the Code of Conduct referred to them by the
Assessment Sub-Panel. The Hearing Sub-Panel are tasked with make a
finding, on the balance of probabilities, whether a subject member
has failed to comply with the code of conduct. If so, the Hearing Panel will also consider what
sanctions, if any, ought to be imposed.
If
the finding of the Hearing Sub-Panel is that there has been a
breach of the code of conduct, this must be ratified by the Court
of Common Council before it takes effect. Following the expiry of the appeal period, if no
appeal is received, the Town Clerk will draft a report to the next
meeting of the Court of Common Council for decision.
